A Bayelsa State High Court presided over by Justice Nayai Aganaba which sat on Tuesday has sentenced a 30-year-old Victoria Gagariga to death by hanging for the killing of her husband, Henry Gagariga.
The incident had happened on February 4, 2015 at the couple’s residence in Yenagoa, Bayelsa State.
The deceased, a lawyer from Sagbama Local Government Area had been cohabiting with his wife, the accused, Victoria who hails from Brass Local Government Area for years before the incident which claimed his life.
According to reports, Victoria was a staff of the Bayelsa Arts and Culture and became legally married to the deceased in 2014.
Victoria was said to have stabbed the deceased on the neck following an altercation which led into a misunderstanding on the day of the incident.
Henry was however confirmed dead subsequently by doctors at the hospital.
Ruling in the case, Justice Aganaba, pointed out that the circumstantial evidence against the accused was overwhelming, adding that all facts presented before the court confirmed that she was the only person with the deceased at the time of death.
The court also stated that she was the only person who could have had the opportunity to have killed the deceased.
The court further stated that the murder was one of passion which was a result of jealousy.
In light of the findings and evidences, the judge said: “It is unfortunate that I can only pronounce the sentence prescribe by law. I wish I had the discretion to do otherwise. However that discretion rests with the Executive Governor of Bayelsa state. I am only left with the compulsion to pronounce the sentence prescribed by law. I hope that person the discretion would look at the circumstance of this case and do the needful. I hereby pronounce my sentence. My sentence upon you is that you shall hang on the neck until you die. May the Lord have mercy on your soul.”
